If Godrej company delay the delivery of your new flat past the promised date, the direct answer is that the law completely protects your investment. You will not lose your hard-earned money. Under strict RERA rules, you have two clear choices: you can either cancel the booking and get a 100 percent refund with extra interest, or you can stay in the project and force the builder to pay you a monthly cash penalty until they finally give you the house keys.

Here is exactly how your buyer rights work and how you can claim your money if the construction gets delayed.

The Legal RERA Deadline

When you book a flat, the sales team might promise to give you the house in three years. However, the only date that matters to the government is the official possession date printed on the builder's RERA certificate.

Godrej must finish the entire building and get an Occupancy Certificate (OC) before this exact legal deadline. If they miss this printed date by even a single month, you immediately get the power to demand financial compensation.

Option 1: Earning Monthly Penalty Money

If you love the location of Godrej Bannerghatta and still want to live there with your family, you can choose to stay in the project despite the delay.

  • How it works: For every single month the builder delays the keys, they must pay you interest on the total money you have already paid them.
  • The interest rate: In Karnataka, the government sets this penalty rate. It is usually the State Bank of India (SBI) main lending rate plus an extra 2 percent.
  • The benefit: This monthly cash penalty helps cover the heavy house rent you are paying while waiting for the new flat to get ready. The builder will usually cut this penalty amount from your final pending payment.

Option 2: Taking a Full Refund

If the builder stops the work completely or delays the project for many years, you might want to leave and buy a ready house somewhere else.

RERA rules give you the full right to withdraw from the project. If you choose this option, Godrej cannot hold your money or charge you any heavy cancellation fees. They are legally forced to return every single rupee you paid them, plus the SBI interest rate, within 45 days of your complaint.

The Six-Month Grace Period

There is only one legal excuse the builder can use to avoid paying the delay penalty.

If a massive natural disaster happens—like a severe flood, an earthquake, or a national lockdown—the government grants the builder a "Force Majeure" extension. This gives them a free grace period of about six months to finish the work without paying penalties. However, simple excuses like a shortage of cement, heavy rain, or fighting with local labor workers do not count as valid reasons for a delay.

How to Claim Your Money

You do not need to hire an expensive private lawyer to fight the builder.

If Godrej misses the deadline and refuses to pay the monthly interest, you simply log into the official state RERA website. You can upload your booking agreement and file a direct complaint online for a very small fee. The RERA court will call the builder, check the legal deadline, and force them to pay your rightful compensation immediately.
