Can You Rent Out Your Apartment Immediately After Buying?

If you just bought a new flat in a project like Godrej Vanantara and want to earn rental income right away, the direct answer is yes. You can legally hand over the keys to a tenant on the exact same day you take possession from the builder.

However, there is one major legal condition you must meet first. You cannot simply rent out a half-finished cement box. Here is a clear guide on exactly when and how you can rent out your new property safely.

The Magic Paper: The Occupancy Certificate (OC)

You cannot legally live in or rent out a new flat just because the builder gives you the keys.

Before anyone moves in, the builder must get an Occupancy Certificate (OC) from the local government (like the BBMP or BDA in Bangalore). This certificate proves that the building is completely safe, has proper fire exits, a working sewage system, and safe electricity.

  • If the builder hands you the possession keys with the official OC, you are 100 percent free to rent it out immediately.
  • If the builder tells you to take the keys but wait a few months for the OC, it is technically illegal to rent it out. If you do, and a fire happens, the insurance company will completely reject your claim.

A Huge 2026 Supreme Court Win for Landlords

In the past, builders used a dirty trick. If you bought a flat and immediately rented it out, builders would argue that you were a "commercial businessman," not a normal homebuyer. They would use this excuse to cancel your 5-year structural warranty or refuse to pay delay penalties.

In February 2026, the Supreme Court of India completely crushed this trick. The court ruled that simply renting out your residential flat does not take away your consumer rights. You still get full RERA protection. The builder cannot run away from their duty to fix cracked walls or leaking pipes just because you put a tenant in the house.

What If You Buy an Old Resale Flat?

If you are buying a 5-year-old resale flat instead of a brand-new pre-launch property, the rules are much easier.

Since the old building already has its OC and is fully functioning, you do not have to wait for any builder approvals. The moment the property registration is done at the local sub-registrar office and the sale deed is signed in your name, you are the absolute owner. You can sign a rental agreement with a tenant on that exact same afternoon.

Getting Your Flat "Rent-Ready"

Even if you have the legal OC, a brand-new flat from a builder is usually just an empty shell. To get a high-paying IT worker to rent your property on Bannerghatta Road quickly, you will need to spend about two weeks fixing it up:

  • Woodwork: You need to build basic kitchen cabinets and bedroom wardrobes. Modern tenants almost never bring their own large wooden furniture.
  • Fittings: The builder provides the wires, but you have to buy and install the actual ceiling fans, lights, and bathroom geysers.
  • Deep Cleaning: Construction sites leave behind massive amounts of fine white cement dust. You will need to hire a professional cleaning crew before showing the flat to any potential tenants.
